The Service is designed to facilitate, not replace, professional real estate practices.
3. User Accounts & Roles
You must create an account and select a role (Buyer, Seller, Agent, or Broker) to use the Service. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration. Agents and brokers represent that they hold valid real estate licenses in their operating jurisdictions.
4. Electronic Signatures
The Service provides electronic signature capabilities compliant with the ESIGN Act and UETA. By using the e-signature features, you consent to conducting transactions electronically. Electronic signatures created through the Service carry the same legal weight as handwritten signatures. You are responsible for verifying the identity of all signers in your transactions.
5. AI-Powered Features
The Service uses artificial intelligence to provide document analysis, contract generation, and advisory features. AI-generated content is provided for informational purposes only and does not constitute legal, financial, or professional real estate advice. Users are responsible for reviewing and verifying all AI-generated content before use. PrimeOffer.ai is not liable for decisions made based on AI recommendations.
6. Document Storage & Privacy
Documents uploaded to the Service are stored securely using industry-standard encryption. Transaction documents are accessible only to verified participants. We do not sell or share your documents with third parties. See our Privacy Policy for complete data handling details.
7. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) upload false or misleading documents; (c) attempt to gain unauthorized access to other users' transactions; (d) interfere with the proper functioning of the Service; (e) use the Service to facilitate fraudulent real estate transactions.
8. Intellectual Property
The Service, including its design, features, and content, is owned by PrimeOffer.ai. Documents you upload remain your property. By uploading documents, you grant us a limited license to process, store, and display them as needed to provide the Service.
9. Limitation of Liability
PrimeOffer.ai provides the Service "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid for the Service in the twelve months prior to the claim. The Service does not replace professional legal counsel or licensed real estate advice.
10. Termination
We may terminate or suspend your account at any time for violation of these terms. Upon termination, your right to use the Service ceases immediately. You may export your data before termination. We will retain transaction records as required by applicable real estate regulations.
11. Governing Law
These terms are governed by the laws of the District of Columbia, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of the District of Columbia.
12. Changes to Terms
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of material changes via email or in-app notification.
